Terms of service

Assure is operated by Kyron Pty Ltd (ABN 42 655 688 145). Last updated 11 September 2026.

1. Who these terms bind

These terms are between Kyron Pty Ltd (“we”, “us”) and the organisation that creates an Assure workspace (“you”, the operator). Creating a workspace is acceptance. If you sign up for an organisation, you confirm you may bind it. Workers scanning a site QR link are not party to these terms; the privacy policy covers how their information is handled.

2. What Assure is — and is not

Assure is software for recording WHS activity: inductions, plant pre-starts, toolbox talks, JSAs, Take 5s, incidents, emergencies and related records. You operate the sites; we provide the platform. Assure is not legal advice, and using it does not itself discharge any duty you hold under the WHS Act 2020 (WA), the model WHS laws or any other law. A record proves what happened. You remain responsible for what happens.

3. Accounts and acceptable use

Keep account details accurate and credentials protected; admin accounts must maintain multi-factor authentication. Do not use Assure for anything unlawful, do not probe or disrupt the service, do not misrepresent records, and do not resell access. We may suspend accounts that put the platform or other customers at risk.

4. The free trial

New workspaces get 30 days with every feature and no payment details taken. When the trial ends without a subscription, the workspace becomes read-only for 14 days, then locks. Records are retained and export tools keep working in both states.

5. Fees

One plan: $99 per month or $990 per year, in Australian dollars, plus GST. Payment is processed by Stripe. Yearly and monthly subscriptions renew automatically until cancelled. We may change prices with at least 30 days’ notice, effective from your next billing cycle — never mid-cycle.

Subscribing during the trial does not bring the first charge forward: it is taken the day the trial ends. A voucher gives a new subscription a stated number of months free. Your card is taken at checkout, the first-charge date is shown before you confirm and again by email, and nothing is charged if you cancel before that date. One voucher per workspace; we may withdraw a voucher code from further use at any time without affecting subscriptions already started.

6. Your data

Workspace records are yours. You grant us the limited licence needed to host, process, back up and deliver them — nothing more. You are responsible for collecting worker information lawfully and for meeting your own record-keeping duties, including retention periods that outlast a subscription. Export tools (evidence packs, CSV and PDF) are available throughout, including while a workspace is read-only or locked. If you ask us to delete a workspace, we delete it on a schedule we confirm with you; retention duties for WHS records remain yours, so export first.

7. Privacy

The privacy policy at /privacy forms part of these terms. It names the sub-processors that store or deliver data on our behalf.

8. Availability and support

We run Assure on reputable cloud infrastructure and aim for it to be available whenever your sites are working, but we do not offer a contractual uptime guarantee. Planned maintenance is notified in advance where practicable. Support is by email to hello@assure.events and we respond as quickly as we can during Australian business hours.

9. Intellectual property

The platform, its design and its code are ours. Your content and records are yours. If you send us feedback, we may use it to improve Assure without owing you anything.

10. Third-party services

Some features rely on third parties: Stripe for payments, SMS and email carriers for broadcasts, Apple and Google for wallet passes, public sources for weather data. Their terms govern their parts, and an outage of theirs is not a breach of ours.

11. Liability

Nothing in these terms excludes rights under the Australian Consumer Law or any other right that cannot be excluded. Where the law allows a limit: our total liability for claims arising out of the service is capped at the fees you paid in the 12 months before the claim; we are not liable for indirect or consequential loss; and for services whose guarantees can be limited, our liability is met by re-supplying the service or paying the cost of re-supply.

12. Suspension and termination

You can cancel any time via the billing page; cancellation takes effect at the end of the period you paid for. Non-payment moves a workspace to read-only, then locked, as in section 4. We may terminate for material breach that is not remedied within 14 days of notice. On termination, section 6 governs your data.

13. Changes to these terms

We may update these terms. Material changes are notified by email or in the app at least 14 days before they take effect. Continued use after that is acceptance; if you do not accept, cancel before the change takes effect.

14. Governing law

These terms are governed by the laws of Western Australia, and the courts of Western Australia have jurisdiction.
